INTRODUCTION
Welcome to the Welsh Sports Association (“WSA”) Terms and Conditions (“Terms”). These Terms apply to your use of the WSA website at www.wsa.wales (“Website”) and, where applicable, the WSA Support4Sport mobile application and associated services (“Support4Sport”).
By accessing or using the Website or Support4Sport, you agree to these Terms. If you do not agree to these Terms, you should not use the Website or the Support4Sport App.
The Website and Support4Sport App are primarily intended for users in the United Kingdom.
DEFINITIONS
For the purposes of these Terms:
“WSA”, “we”, “us” or “our” means the Welsh Sports Association.
“Website” means the website located at www.wsa.wales or any subsequent URL which may replace it.
“Support4Sport” means the WSA Support4Sport mobile application, including its Android and iOS versions, and any associated web-based services provided by the WSA.
“Volunteer” means an individual who creates a Support4Sport account or uses Support4Sport to search for, express an interest in, or apply for volunteering opportunities.
“Recruiting Organisation” means a WSA member organisation which uses the Support4Sport App to advertise or manage volunteering opportunities or receive applications or expressions of interest from Volunteers.
“Services” means the Website and the Support4Sport App, collectively where appropriate.
“User”, “you” or “your” means a person accessing or using the Services, including, where appropriate, a Volunteer or an authorised representative of a Recruiting Organisation.
1. ACCESS
1.1 We will provide you with access to the Services in accordance with these Terms.
1.2 Certain features of Support4Sport require you to create and maintain a registered account. Access to particular features may depend upon whether you are using Support4Sport as a Volunteer or on behalf of a Recruiting Organisation.
1.3 We do not guarantee that all features of the Services will be available at all times or on every device, operating system or platform.
2. SUPPORT4SPORT VOLUNTEER APP
2.1 Purpose of Support4Sport
Support4Sport is a digital service operated by WSA which helps individuals identify and apply for volunteering opportunities made available by participating sporting and other organisations.
WSA provides the platform through which Volunteers and Recruiting Organisations can connect. Unless a volunteering opportunity is expressly stated to be with WSA itself, WSA is not the organisation engaging the Volunteer and is not a party to any subsequent volunteering arrangement between the Volunteer and the Recruiting Organisation.
2.2 Minimum age
You must be aged 14 or over to create a Support4Sport Volunteer account.
Some volunteering opportunities may have a higher minimum age because of the nature of the activity, insurance requirements, safeguarding arrangements or requirements imposed by the Recruiting Organisation. Being eligible to create a Support4Sport account does not mean that you will be eligible for every volunteering opportunity advertised through Support4Sport.
Where a Volunteer is under 18, the Recruiting Organisation is responsible for determining whether a particular volunteering opportunity is suitable for a young person and for implementing appropriate safeguarding, supervision, consent and risk-management arrangements.
2.3 Volunteer accounts
When creating or maintaining a Support4Sport account, you must provide information that is accurate, current and not misleading.
You are responsible for maintaining the confidentiality of your account login credentials and must not knowingly permit another person to use your account.
You must notify WSA promptly if you know or suspect that somebody has accessed your account without your authorisation.
You must not create an account using another person’s identity or knowingly provide false, misleading or materially incomplete information.
You are responsible for keeping your Support4Sport profile reasonably up to date.
2.4 Applying for volunteering opportunities
When you apply for or express an interest in a volunteering opportunity through Support4Sport, relevant information from your Support4Sport profile and/or application may be made available to the relevant Recruiting Organisation so that it can consider and administer your application.
Further information regarding the personal information collected through Support4Sport, how WSA uses that information and when information is shared with Recruiting Organisations is set out in our Privacy Policy at www.wsa.wales/privacy-policy/.
Submitting an application or expression of interest does not guarantee that you will be offered or accepted for a volunteering opportunity. Recruitment and selection decisions are made by the relevant Recruiting Organisation unless WSA expressly states otherwise.
2.5 Responsibilities of Recruiting Organisations
Recruiting Organisations are responsible for the volunteering opportunities they advertise through Support4Sport and for ensuring that information contained in their listings is accurate, current and not misleading.
Recruiting Organisations are responsible for their own recruitment and selection decisions and, where applicable, for ensuring that appropriate risk assessments, health and safety arrangements, safeguarding arrangements, supervision, training, insurance, eligibility requirements and background checks are in place in respect of their volunteering opportunities.
Recruiting Organisations must handle personal information received about Volunteers in accordance with applicable data protection law and must only use such information for appropriate purposes connected with the relevant application, recruitment process and subsequent volunteering relationship, unless another lawful basis permits its use.
Recruiting Organisations should promptly update, close or remove opportunities that are no longer available.
WSA does not guarantee that a Volunteer will be selected for an opportunity or that an opportunity advertised through Support4Sport will remain available.
2.6 Safeguarding
WSA is committed to safeguarding children and adults at risk. Users of Support4Sport must comply with applicable safeguarding requirements and any safeguarding policies or procedures notified to them in connection with a volunteering opportunity.
Recruiting Organisations are responsible for establishing and maintaining appropriate safeguarding arrangements for the opportunities they advertise, including any appropriate supervision, risk assessments, safer recruitment procedures and Disclosure and Barring Service (“DBS”) or other eligibility checks.
Where a safeguarding concern arises in connection with a volunteering opportunity, Volunteers should follow the Recruiting Organisation’s safeguarding procedures and, where appropriate, notify WSA. Where there is an immediate risk of harm, the appropriate emergency services or relevant authority should be contacted.
2.7 DBS checks, qualifications and eligibility requirements
Some volunteering opportunities may require a DBS check, particular qualifications, training or other eligibility requirements. Where applicable, these requirements should be identified by the Recruiting Organisation.
Unless WSA expressly states otherwise in relation to a particular opportunity, responsibility for determining whether particular checks are required and for carrying out the appropriate checks rests with the Recruiting Organisation.
The availability of an opportunity on Support4Sport does not mean that WSA has carried out a DBS check, background check or other vetting of a Volunteer or that WSA has confirmed a Volunteer’s suitability for a particular role.
2.8 Nature of the volunteering relationship
Use of Support4Sport does not create an employment, worker, agency, partnership or similar relationship between WSA and a Volunteer. Unless expressly stated otherwise, opportunities advertised through Support4Sport are volunteering opportunities rather than employment opportunities.
Where a Volunteer is recruited or accepted by a Recruiting Organisation, responsibility for managing and supervising the volunteering relationship rests with the Recruiting Organisation.
3. YOUR OBLIGATIONS
3.1 You agree:
3.1.1 not to use the Services (or any part of them) for any illegal purpose and to use the Services in accordance with all relevant laws;
3.1.2 not to upload or transmit through the Services any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt normal computer operations;
3.1.3 not to upload or transmit through the Services any material which is defamatory, offensive, obscene, threatening or unlawful;
3.1.4 not to use the Services in a way that may cause them to be interrupted, damaged, rendered less efficient or otherwise impair their operation;
3.1.5 not to use the Services in any manner which violates or infringes the rights of any person or organisation, including intellectual property, confidentiality or privacy rights;
3.1.6 not to attempt unauthorised access to any part or component of the Services;
3.1.7 not to provide information which you know to be false or materially misleading;
3.1.8 not to impersonate another person or misrepresent your identity or your authority to represent an organisation;
3.1.9 not to harass, intimidate, threaten or abuse any Volunteer, Recruiting Organisation or other User;
3.1.10 not to use personal information obtained through Support4Sport for purposes unrelated to legitimate volunteering, volunteer recruitment or the relevant volunteering opportunity;
3.1.11 not to use Support4Sport to send unsolicited commercial marketing or other unauthorised communications;
3.1.12 not to upload or publish discriminatory, abusive, inappropriate or unlawful material; and
3.1.13 not to attempt to circumvent any security, account or access controls within the Services.
4. INDEMNITY
You are responsible for losses reasonably incurred by WSA as a direct result of your deliberate or unlawful misuse of the Services or your material breach of these Terms, to the extent permitted by law.
Nothing in these Terms requires an individual User to indemnify WSA for losses caused by WSA’s own negligence or breach of law, or excludes or restricts any liability which cannot lawfully be excluded or restricted.
5. OUR RIGHTS AND CHANGES TO THE SERVICES
5.1 We may modify, update, suspend or withdraw all or part of the Services where reasonably necessary, including for maintenance, security, technical, legal or operational reasons.
5.2 We may amend these Terms from time to time. Where a change materially affects the rights or obligations of registered Support4Sport Users, we will take reasonable steps to notify those Users before, or at the time at which, the revised Terms take effect.
5.3 The date on which these Terms were last updated will be displayed at the top of these Terms.
5.4 We will use reasonable endeavours to maintain the Services but cannot guarantee uninterrupted or continuous availability.
6. THIRD-PARTY LINKS AND CONTENT
The Services may contain links to third-party websites or resources.
We are not responsible for the availability or content of external websites or resources and do not control their privacy practices.
Support4Sport may also display information, content and links provided by Recruiting Organisations or other third parties. Unless expressly stated otherwise, WSA does not endorse third-party websites merely because they are linked to or referenced within the Services.
Users should review the applicable terms and privacy information of third-party services before using them.
7. MONITORING, SUSPENSION AND TERMINATION
7.1 We may investigate reported breaches of these Terms, complaints or concerns relating to use of the Services.
7.2 We may issue warnings, suspend or terminate an account, remove a volunteering opportunity, remove content, restrict access to Membership Benefits, Support4Sport or take other reasonable action where we reasonably believe that:
7.2.1 these Terms have been materially breached;
7.2.2 information supplied through the Services is materially inaccurate or misleading;
7.2.3 activity may present a safeguarding, legal, privacy or security risk;
7.2.4 the Services are being misused; or
7.2.5 action is reasonably necessary to protect Volunteers, Recruiting Organisations, WSA or other Users.
7.3 Where appropriate and reasonably practicable, we may notify a User of action taken in relation to their account.
8. YOUR PERSONAL INFORMATION
8.1 WSA takes the protection of personal information seriously. Personal information collected through the Website and Support4Sport will be handled in accordance with our Privacy Policy.
8.2 Where you use Support4Sport to apply for or express an interest in a volunteering opportunity, relevant personal information may be made available to the Recruiting Organisation as described in our Privacy Policy.
8.3 Our Privacy Policy explains the categories of personal information we collect, why we process it, who we may share it with, how long we retain it and the rights available to individuals in relation to their personal information.
8.4 We may disclose information where required or permitted by law, including where reasonably required in connection with safeguarding concerns, law enforcement, regulatory requirements or legal proceedings.

9. INTELLECTUAL PROPERTY AND RIGHT TO USE
9.1 All copyright, trade marks and other intellectual property rights in the Services, including the Website and Support4Sport, their software, code, interfaces, designs, databases, text, graphics, branding, images and other content provided by WSA, remain vested in WSA or its licensors.
9.2 You may use WSA material solely for lawful personal and non-commercial purposes unless we expressly agree otherwise.
9.3 You must not copy, reproduce, transmit, publish, distribute, commercially exploit or create derivative works from WSA’s intellectual property except where permitted by law or expressly authorised by WSA.
9.4 Where a Recruiting Organisation uploads an opportunity description, logo, photograph or other material to Support4Sport, it confirms that it owns that material or has the necessary rights and permissions to use it.
9.5 The Recruiting Organisation grants WSA a non-exclusive, royalty-free licence to host, reproduce, display and otherwise use that material to the extent reasonably necessary to operate, administer and promote Support4Sport and the relevant volunteering opportunity.
10. USER CONTRIBUTIONS
10.1 Where Users are permitted to submit information, text, photographs, graphics or other content through the Services (“User Content”), they retain ownership of any intellectual property rights they hold in that content.
10.2 By submitting User Content, you grant WSA a non-exclusive, royalty-free licence to host, process, reproduce and display that content to the extent reasonably necessary to provide, administer and promote the Services and, where applicable, the relevant volunteering opportunity.
10.3 You confirm that you have the necessary rights or permissions to provide any User Content submitted by you and that the content does not knowingly infringe another person’s rights or applicable law.
11. APP STORES
11.1 Support4Sport may be made available through third-party app stores, including the Apple App Store and Google Play.
11.2 Your use of an app store is subject to any separate terms and conditions imposed by the relevant app store provider.
11.3 Apple and Google do not operate Support4Sport and are not responsible for volunteering opportunities made available through Support4Sport.
12. ACCOUNT CLOSURE
12.1 You may stop using Support4Sport and request closure of your account at any time using any account-closure functionality made available through Support4Sport or by contacting WSA.
12.2 Closure of an account does not necessarily result in immediate deletion of all personal information where WSA has a lawful reason to retain particular information. Further information regarding retention and your data protection rights is available in our Privacy Policy.
12.3 Closing your Support4Sport account will not necessarily affect information that has already been lawfully provided to a Recruiting Organisation in connection with an application. The Recruiting Organisation may have its own lawful basis and retention requirements in relation to that information.
13. AVAILABILITY OF SUPPORT4SPORT
13.1 We aim to keep Support4Sport available and functioning effectively but cannot guarantee that it will be continuously available, uninterrupted or error-free.
13.2 We may temporarily suspend or restrict availability where reasonably necessary for maintenance, updates, security, technical reasons or circumstances beyond our reasonable control.
13.3 From time to time, we may update Support4Sport or require Users to install an updated version of the App to continue accessing particular features.

If you are contacting us about Support4Sport, please include sufficient information to enable us to identify your account or query, but you should not send passwords or other account-security credentials by email.
15. LIMITATION OF LIABILITY
15.1 We use reasonable endeavours to provide accurate information through the Services. Information concerning volunteering opportunities may, however, be supplied by Recruiting Organisations, and those organisations are responsible for ensuring that their opportunity information is accurate and kept up to date.
15.2 WSA provides Support4Sport primarily as a platform through which Volunteers and Recruiting Organisations can connect. Unless expressly stated otherwise, WSA does not organise, manage or supervise volunteering opportunities advertised by third-party Recruiting Organisations.
15.3 Recruiting Organisations are responsible for their opportunity listings, recruitment and selection decisions and the management and supervision of Volunteers they engage.
15.4 WSA does not guarantee that a particular volunteering opportunity will be suitable for a particular Volunteer, that an opportunity will remain available or that a Volunteer will be selected.
15.5 Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, nothing excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or restricted.
15.6 Nothing in these Terms affects any statutory rights which you may have and which cannot lawfully be excluded or restricted.
15.7 To the extent permitted by law, WSA will not be responsible for losses caused solely by the acts or omissions of a Recruiting Organisation or Volunteer where those acts or omissions are outside WSA’s reasonable control.
16. SEVERANCE
If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision shall, to the extent required, be treated as severable and shall not affect the validity and enforceability of the remaining provisions.
17. WAIVER
No failure or delay by WSA in exercising or enforcing any right under these Terms shall constitute a waiver of that right.
18. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Membership Terms & Conditions and any additional terms expressly applicable to a particular WSA service, constitute the agreement governing your use of the Services.
Where separate terms apply to Recruiting Organisations using Support4Sport, those additional terms will apply to the Recruiting Organisation’s use of the relevant Support4Sport functionality.
19. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
Subject to any rights you may have under applicable law to bring proceedings elsewhere, the courts of England and Wales shall have jurisdiction in relation to disputes arising from these Terms.
20. RECRUITING ORGANISATIONS
Where an organisation creates an account or otherwise uses Support4Sport to advertise volunteering opportunities, the individual acting on behalf of that organisation confirms that they have appropriate authority to do so.
Recruiting Organisations must:
20.1 only advertise genuine volunteering opportunities;
20.2 ensure opportunity descriptions and eligibility requirements are accurate and kept reasonably up to date;
20.3 determine an appropriate minimum age for each opportunity, taking into account the nature of the role, safeguarding arrangements, insurance and any applicable legal or regulatory requirements;
20.4 make appropriate safeguarding arrangements, particularly where Volunteers may be under 18 or work with children or adults at risk;
20.5 undertake appropriate risk assessments and health and safety arrangements for the volunteering activities they organise;
20.6 determine whether a DBS check, qualification, training, licence or other eligibility requirement is necessary or appropriate for a particular opportunity;
20.7 ensure appropriate insurance arrangements are in place where required;
20.8 provide appropriate supervision and support to Volunteers;
20.9 make their own recruitment and selection decisions;
20.10 comply with applicable equality, safeguarding, health and safety and data protection requirements;
20.11 only use personal information received through Support4Sport for lawful purposes connected with the relevant application, recruitment and volunteering relationship, unless another lawful basis permits further use;
20.12 ensure that they have appropriate rights and permissions in relation to logos, photographs, descriptions and other content uploaded to Support4Sport;
20.13 promptly update, close or remove opportunities that are no longer available; and
20.14 notify WSA where they become aware of a material safeguarding, security or misuse concern connected with Support4Sport.
